Gynecologist Convicted on Majority of Federal Charges

NRI PULSE STAFF REPORT

Memphis, TN, January 11, 2025:  A federal jury has found Dr. Sanjeev Kumar, a Memphis-based gynecologist, guilty on 40 of the 46 federal counts he faced, following a weeks-long trial that detailed widespread health care fraud and unsafe medical practices at his women’s health clinic.

The verdict was delivered after nearly five days of jury deliberations. Jurors were unable to reach a unanimous decision on the remaining six counts.

Federal prosecutors said Kumar carried out thousands of medically unnecessary procedures, primarily hysteroscopies with biopsies, over a five-year period between 2019 and 2024. According to court records, many of these procedures involved the reuse of single-use medical devices or instruments that were not properly sterilized, placing patients at risk.

Prosecutors further alleged that Kumar and his clinic staff fraudulently billed Medicare and Medicaid, submitting claims for procedures that were either unnecessary or improperly performed. Authorities estimate that more than 15,000 procedures were involved, with over $41 million billed to insurers. Of that amount, approximately $4.8 million was paid by government health programs.

In addition to health care fraud, Kumar was convicted on charges related to the adulteration and misbranding of medical devices, violations that fall under federal safety regulations governing medical equipment use.

The trial lasted more than three weeks and featured testimony from former employees, medical experts, and federal investigators. Evidence presented included billing records, medical logs, and details of clinic practices that prosecutors said prioritized profit over patient care.

Kumar operated his clinic on Poplar Avenue in Memphis. Federal authorities began investigating the practice several years ago following complaints and irregular billing patterns.

Sentencing is scheduled for April 9, 2026. Kumar faces the possibility of a lengthy federal prison term, with potential sentences running into decades under U.S. sentencing guidelines. His legal team has indicated that he plans to appeal the verdict.
