Miami, FL, August 3, 2026 — Neha Gupta, the Oklahoma pediatrician accused of murdering her four-year-old daughter and staging her death as an accidental drowning in a Florida Airbnb pool, is asking a judge to intervene after alleging she was assaulted and threatened by a fellow inmate while awaiting trial.
In an emergency court filing, Gupta, 36, claims another inmate in her housing unit at the Miami-Dade County jail has physically attacked her on multiple occasions and recently threatened to kill her.
According to the motion filed by her attorney, the inmate first entered Gupta’s cell in January and repeatedly punched her in the face, leaving her with bruises and damaging her prescription eyeglasses. The filing states that criminal charges were brought against the inmate following the alleged assault, and she was temporarily moved to another housing unit before later being returned to the same cell block.
Gupta further alleges that on July 17, the inmate banged on her cell door and shouted, “I am going to kill you.” The motion also claims that on July 24, another inmate associated with the woman assaulted Gupta in an incident that is reportedly under investigation.
Her attorney has asked the court to order jail officials to separate the inmates, arguing that Gupta fears for her safety and that the jail has failed to adequately protect her despite the earlier alleged attack.
The judge had not ruled on the request as of the latest reports.
Gupta remains jailed without bond while awaiting trial on a charge of first-degree murder in the June 2025 death of her four-year-old daughter, Aria Talathi.
Prosecutors allege Gupta smothered the child before placing her body in the swimming pool of a rented Airbnb home in El Portal, Florida, in an attempt to stage an accidental drowning. Authorities say the medical examiner found no evidence that the child drowned, instead concluding she died from asphyxiation.
Gupta has pleaded not guilty and maintains her innocence. Her defense has not publicly addressed the prosecution’s forensic allegations but is now seeking court intervention over the conditions of her confinement.
The homicide case has attracted national attention because of the allegations that a physician deliberately staged the death of her young daughter, as well as the ongoing custody dispute between Gupta and the child’s father that prosecutors say preceded the girl’s death.
